1. Important Information And Who We Are

This privacy policy aims to give you information on how Aleph Express collects and processes your personal data through your use of this website or the App, including any data you may provide through this website or App when you sign up for an Aleph Express Account and use any Aleph Express Services, sign up to our newsletter or sign up for one of our events or webinars.

This website is not intended for children, and we do not knowingly collect data relating to children.

It is important that you read this privacy policy so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

This privacy policy is issued on behalf of the Httpool Bangladesh Ltd. and the Aleph Express app so when we mention «Aleph Express», «we», «us», or «our» in this privacy policy, we are referring to Httpool Bangladesh Ltd., who is the controller and responsible for this website and App.

We keep our privacy policy under regular review. This version was last updated in April 2023.. Historic versions can be obtained by contacting us. It is the visitor's responsibility to periodically review the content of this Privacy Policy on our webpage and App where the changes made will be published together with the data of the last update.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

1.4 Third Party Links

This website or our App may include links to third-party websites, plug-ins and applications. For example we may use Payment gateways providers website, logistics/delivery providers website, Facebook Pixel, Google Analytics API tracking, SM connections: FB, IG, LinkedIn, Digital Ad Expert by Aleph (if providing information on education in blog posts), Aleph website (if introducing “About Us/Learn More” section), creative plug-in (e.g. Canva or similar if in the roadmap for implementation, LiveChat (if plugged-in), Customer onboarding (if using 3rd party tools, e.g. Userlane). Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.

2. The Data We Collect About You

2.1 Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  1. On our websites: We collect personal data when you submit web forms to us (for example, when you register for a webinar or create an Aleph Express account with us) or interact with our sites (for example cookies). We may ask for your email address, first and last name, whether you are an agency or advertiser, country, and other such business information. You can freely browse our website without having to provide personal data.

  2. Through our App: When you use our App to create an Aleph Express Account, we will collect the personal data in the application you submitted, such as email and phone number. To be able to offer you our services via the App, we might also collect or access personal information including your full name, date of birth, address, photos/videos/files that you grant us permission to access, and device ID.

  3. Special events: When you register for our webinars or special events, we collect information such as your name, address, telephone number and email address. We may use this information to contact you and, in some cases, assist you with registration.

  4. Customer Testimonials: We post comments and testimonials on our websites and these may contain personal data. We obtain the consent of each client by email or through other agreements with us before publishing their name and testimonial.

  5. Linking with Meta and/or other social media platforms: If you use linking from your “Meta” and/or other social media platforms account to promote your Website´s products and/or services, by placing advertisements, you will be asked to give us access to information from your mentioned account. The use and transfer to any other application of information that Aleph Express receives from Meta APIs adheres to the Meta API Services User Data Policy, including limited use requirements.

  6. Payment details: all payments are being processed directly by our partner payment providers and we will not have access to your payment details, just the overall amount paid and the products purchased.   7. Data related to Meta and/or other social media platform messenger tool: we will have access to information who and when is using the Meta messenger tool, but will have no access to the content of the messages exchanged. We also collect, use and share Aggregated Data, such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

2.2 If You Fail To Provide Personal Data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

3. How Is Your Personal Data Collected?

We use different methods to collect data from and about you including through:

4. How We Use Your Personal Data

  • Where we need to perform the contract we are about to enter into or have entered into with you (meaning provision of Aleph Express Services).
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.

4.1 Purposes For Which We Will Use Your Personal Data

4.1.1 We have set out below a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground we are relying on to process your personal data where more than one ground has been set out.

Mostly we process your personal data for the following purposes:

  1. Comply with our legal obligations.
  2. Implement commercial, organisational and marketing strategies.
  3. Carry out any activity necessary for the effective fulfilment of the commercial obligations that we have with suppliers and/or clients.

In addition, we may contact you by phone to discuss our other products or services that may be of interest to you.

To communicate with you about the services we use the data you provide to us when you register. We also send you updates related to our Terms of Service for customers and other legal agreements, and we may contact you by email or with a notification to report security incidents.

Finally, we use your information to provide support, for example to solve technical problems and analyse failures and interruptions in the service.

4.1.2 For use of our services

  • We use your account information and customer data to provide you with our products and services. For example, we use the email address you provide us when you sign up to create your user account.
  • We collect data about how our products and services are used by monitoring and tracking our users. We use this data to develop and improve our products and services. For example, usage data allows us to evaluate trends and product usage to help us determine what new features or integrations our users might be interested in. We may share Usage Data externally, but only after it is anonymized and/or aggregated to create or improve features.
  • We use anonymized customer information for machine learning that is used in certain features and functionality of products within the subscription service. You can request that your data not be used for the latter purpose by sending an email to us.

To protect our users:

  • We use your account information to investigate and prevent security incidents. We may also use this information to comply with legal requirements.

For research and development purposes

  • We may provide statistical information to third parties about our users, although such information will not be used to identify any individual person and will only be shared in an aggregated, de-identified manner; for example, we might post blog posts about trends and product interaction data.

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

4.7 Change Of Purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

5. Disclosures Of Your Personal Data

We may share your personal data with the parties set out below for the purposes set out in point 4.1 “Purposes for which we will use your personal data” above.

  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

6. International Transfers

We may share your personal data within the Aleph Group Inc. which is the holding company of different legal entities, details of which can be found here: LINK.

The client expressly authorises Aleph Express to store their data in the way it deems most appropriate and comply with the security required for the protection of the client's data.

6.1 Transferring Data Of EU Visitors

In some specific cases we may have to transfer personal data of an EU visitor also outside the EU.

Also some of our external third parties are based outside the EU so their processing of your personal data will involve a transfer of data outside the EU.

Whenever we transfer your personal data out of the EU, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
  • Where we use certain service providers, we may use specific contracts approved for use in the EU which give personal data the same protection it has in the EU.
  • Using also Standard Contractual Clauses.

7. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data Retention

8.1 How Long Will You Use My Personal Data For?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

9.1 How To File Your Request

You can file your express request to exercise your rights free from any charge, at any time, by using the contact details provided in this document, or via your legal representative.

9.2 How And When We Will Respond To Your Request

We will strive to promptly respond to your requests.

In any case, should it be impossible for us to do so, we’ll make sure to communicate to you the factual or legal reasons that prevent us from immediately, or otherwise ever, complying with your requests. In cases where we are not processing your personal information, we will indicate to you the physical or legal person to whom you should address your requests, if we are in the position to do so.

In the event that you file an access or personal information processing confirmation request, please make sure that you specify whether you’d like your personal information to be delivered in electronic or printed form.

You will also need to let us know whether you want us to answer your request immediately, in which case we will answer in a simplified fashion, or if you need a complete disclosure instead.

In the latter case, we’ll respond within 30 days from the time of your request, providing you with all the information on the origin of your personal information, confirmation on whether or not records exist, any criteria used for the processing and the purposes of the processing, while safeguarding our commercial and industrial secrets.

In the event that you file a rectification, deletion, anonymization or personal information blocking request, we will make sure to immediately communicate your request to other parties with whom we have shared your personal information in order to enable such third parties to also comply with your request – except in cases where such communication is proven impossible or involves disproportionate effort on our side.

9.3 No Fee Usually Required

You will not have to pay a fee to access your personal data (or to exercise any of the rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

9.4 What We May Need From You

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

9.5 Time Limit To Respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

10. Glossary

Lawful Basis

Legitimate interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

Your Legal Rights

You have the right to:

Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us to continue to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restrictions of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data´s accuracy.
  • Where our use of the data is unlawful but you do not want us to erase it.

We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.
